GENERAL DESCRIPTIONThe Fill Up Our Forum Contest will begin on February 9, 2009 and will end on March 8, 2009. AP Wagner, an appliance parts distributor, and owner of the "Fill up our Forum" Contest, is asking members of the public to register with the AP Wagner Appliance Forum and post any appliance repair question they may have to help kick off the new AP Wagner forum. Only questions that contain valid information regarding an appliance, and conform to the standards and practices of AP Wagner, as they determine in their sole discretion, will be eligible for consideration. PROCEDURES1. Persons wishing to enter should visit www.apwagner.com and click on the appliance forum registration link. Persons must agree to forum rules, and enter a valid user name, password, email address, and meet all eligibility requirements set forth here-in. Once registered, a person must then choose a forum from the list and post an appliance question or answer. Questions must contain appliance model number, brand, appliance age, and the topic of the post must pertain to the category the person chooses to post in. Answers must pertain to the category and question the person chooses to post about. Questions and answers will be reviewed on an ongoing basis. Every Friday, during the contest dates, AP Wagner will randomly select three (3) users who have posted questions and reward each user with one (1) $50 Visa gift card. 2. There is no limit to how many questions or answers a user may post on the AP Wagner Appliance Repair Forum, however only valid users that post questions that follow the above mentioned requirements will qualify for the drawings. Each Question or answer entry will roll over into each weekly drawing. Person may only be a "prizewinner" one time during the duration of the contest. 3. All submissions become the sole property of AP Wagner and may be used in any manner in all media. AP Wagner is not responsible for lost, damaged or misdirected submissions under any circumstances. AP Wagner is not responsible for Internet system and hardware failures delayed, incomplete or unsuccessful registration or other entry information, technical malfunctions of any kind, human error, information loss and downtime, or any costs, losses, liability or damages resulting from any such failures. 4. When submitting a question to the AP Wagner Appliance Forum via APWagner.com, it is recommended that the question be as specific as possible and located in the correct category (i.e. dishwasher repair questions are to be posted in the Dishwasher repair category). Instructions for posting a question can be found at www.apwagner.com. Entrant understands and agrees his/her submission may receive exposure on apwagner.com and may be subjected to comments and popularity ratings from the public at large. Producer is not responsible for any critical or derogatory remarks posted by the public pertaining to an entrant or an entrant's video. 5. AP Wagner reserves the right to delete, edit and/or alter any submission. Any posts that do not contain the above specified information, are posted in the incorrect location, or contains any offensive material as per the discretion of AP Wagner, will be deleted. 6. AP Wagner decisions regarding all contest matters are final and non-appealable. All submissions are subject to the terms of these rules and all entrants agree to be bound by these rules and AP Wagner's decisions. AP Wagner reserves the right to amend these rules at any time and AP Wagner will post the rule changes on apwagner.com. The rules in effect at whatever time the submission is judged will apply regardless of submission date. 7. AP Wagner may, in its sole discretion, take whatever measures it deems necessary or appropriate to preserve the fairness and integrity of the contest. ELIGIBILITY1. Employees of AP Wagner and affiliated companies and anyone involved in the production, or administration of the contest, as well as immediate family/same household members of anyone so employed or engaged are not eligible for prize awards. 2. Contest is open only to legal residents of the 50 United States and D.C. and Canada, excluding Quebec. Void in Quebec, Guam, Puerto Rico, U.S. Virgin Islands and other U.S. territories, and where prohibited or restricted by law. 3. AP Wagner reserves the right to at any time implement new eligibility criteria and/or modify existing eligibility criteria, including, without limitation, geographical and age restrictions. 4. Submitter must be 18 years of age or older as of the date of entry. Written parental consent will be required for persons under 18 (or who are not of the age of majority in their state of domicile) before their entries will be considered. 5. Each submission must be solely the original work of entrant. 6. Each entrant represents that his/her submission does not infringe on any third party's copyrighted material, trademark or other intellectual property rights, or privacy or publicity rights. 7. By submitting an entry, each entrant agrees to release, discharge, defend and hold harmless AP Wagner and affiliated companies; and their respective licensees; assigns; officers; directors; employees; agents and representatives from and against any claim, expense or liability arising from or related to submission, exhibition or exploitation of the entry, participation in this contest (or any related sweepstakes), appearance on the program, and/or acceptance or use of any prize. 8. Each entrant agrees that his/her participation and submission shall be governed by and construed under and in accordance with the laws of the State of New York applicable to contracts entered into and wholly performed therein. Each entrant consents and agrees to the exclusive jurisdiction and venue of the federal and state courts of the State of New York, located in the County of Erie. 9. Odds on winning depend on the number of acceptable question the user has submitted and the number of entries received. No purchase is necessary to enter. WINNER SELECTION1. Decisions of AP Wagner management with respect to the contest are final. 2. Every week, during contests dates, three (3) users that have posted questions on the AP Wagner Appliance Repair Forum will be selected at random and rewarded the weekly prize. 3. Limit one prize per user. PRIZES1. Each week during the contest dates, AP Wagner will give away three (3) $50 Visa gift cards. A total of twelve (12) gift cards will be given away throughout the promotion for a total of $600 in prizes. 2. AP Wagner reserves the right to terminate, suspend and/or modify the competition and/or limit, reduce or not award the announced prizes. 3. Prizes will be awarded to the person(s) submitting the question or answer, provided they certify and establish to AP Wagner's satisfaction that they are the user of the forum account and further provided that they have complied with the official rules and signed all necessary forms as determined by AP Wagner. 4. Winners of any prize are solely responsible for all federal, state and local taxes. 5. CONTEST DEADLINEThe deadline date for submissions is February 27, 2009. All users must be registered and questions must be posted on the AP Wagner Appliance Repair Forum on or before the deadline dates to be eligible for inclusion in the contest. RELEASES1. All entrants must sign all consent forms, general releases and other documentation in the form provided by AP Wagner or be eliminated from consideration and made ineligible to win any prize. 2.
